VisionPort Cloud Terms of Service
Welcome to VisionPort Cloud! These Terms of Service ("Terms") govern your use of the VisionPort Cloud services (the "Service"), a product of End Point Corporation. By accessing or using the Service, you agree to comply with these Terms. If you do not agree, please do not use the Service.
By signing up for or using VisionPort Cloud, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.
- You retain ownership of any content you create, upload, or otherwise use within the Service.
- You are solely responsible for ensuring that any content you create, share, or present through the Service complies with applicable copyright, trademark, intellectual property, and other laws.
- You warrant that you have all necessary rights to use and distribute any content uploaded or presented within the Service.
You agree not to use the Service to create, upload, distribute, or share content that:
- Violates any applicable laws or regulations.
- Infringes on any third party’s intellectual property rights.
- Is pornographic, obscene, defamatory, or otherwise offensive.
- Promotes hate speech, violence, or discrimination.
- Includes malicious software, viruses, or any form of malware.
End Point Corporation reserves the right to determine, at its sole discretion, whether content violates these Terms and may suspend or terminate access accordingly.
- You may not use the Service in any manner that disrupts, overburdens, or interferes with our systems or networks.
- You may not reverse-engineer, decompile, or otherwise attempt to derive the source code of any part of the Service.
- You may not resell, sublicense, or commercially exploit the Service without prior written consent from End Point Corporation.
- Access to certain features of the Service may require a paid subscription. You agree to pay all fees associated with your chosen subscription plan in accordance with our published pricing.
- Payments are due in advance for the applicable subscription period (e.g., monthly, quarterly, annually) and are non-refundable.
- If you choose to discontinue use of the Service before the end of your subscription period, you will not be entitled to a refund, partial or otherwise.
- End Point Corporation reserves the right to change pricing at any time, with reasonable notice provided via email or through the Service.
End Point Corporation reserves the right to suspend or terminate your account at any time, with or without notice, if:
- You violate these Terms.
- You engage in activities that harm the performance, integrity, reputation, or security of the Service.
- You create or distribute content that we deem inappropriate, including pornography or other offensive material.
- The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind.
- End Point Corporation is not responsible for any content created or shared using the Service.
- End Point Corporation reserves the right to modify, suspend, or discontinue the Service at any time, for any reason, with or without notice.
- IN NO EVENT SHALL EITHER PARTY BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- THE ENTIRE LIABILITY OF END POINT CORPORATION UNDER ANY PROVISION OF THESE TERMS SHALL BE LIMITED TO THE AMOUNT YOU PAID TO END POINT CORPORATION FOR USE OF THE SERVICE IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
- The above limitation shall not apply to any indemnity obligations expressly stated in these Terms.
We may update these Terms at any time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms shall be governed by and interpreted under the laws of the State of New York. Any disputes arising under these Terms shall be resolved in the courts of the State of New York.
